Aug 3, 2011: Two found guilty for rape and murder of four-year-old

NAGPUR: District and Third Additional Sessions Judge GT Kadri has held two youths, in their early 20s, guilty for raping and murdering a four-year-old girl at Bhagirathi layout in MIDC in May 2008. The verdict on the sentence is expected to be delivered on Wednesday. There were around 30 injuries on the girl including two after deaths.

The court has held Mangesh Kapate and Shyam Kase responsible for rape and throttling Anchal Manwar to death. The prosecution could not prove charges against Satish Warkhede and Gopal Walde, co-accused in the crime, who were among the seven held in the case. Three minors were also taken into custody but their trial was conducted separately.

Around 16 witnesses were examined by the prosecution counsel which included two persons who had last seen Anchal with Kapate and Kase. It was learnt that Anchal's maternal uncle's friend Asfaque and another relative of the Manwar Krishna Sonwane had spotted the girl playing with Kapate who had headed towards his residence with her on the opposite side of the Manwar's residence. Anchal was later found dead in the garbage behind the boundary wall of Kapate's residence.

Prosecution counsel additional public prosecutor Jyoti Vajani said that the fact has come on record that Kapate and Kase had left the residence at 9.30 pm. "The incident took place between 8 pm and 9.30 according to medical evidence," said Vajani. The medical examination of Kapate, arrested on the following day of the incident, suggested he had forceful intercourse within 24 hours. Kase was arrested after five days. The medical examination had also suggested injuries on the body which was around five-day old.

The prosecution had also produced a blood-stained bed sheet, found at the house of Kapate where the offence had taken place, before the court. It was also learnt that Kapate and Kase did not return home despite the fact that they had invited friends at their residence for a party that day.
