Feb 18, 2013: Man raped girl on promise of marriage, gets 10-year jail

TNN | Feb 18, 2013, 03.15 AM IST
NEW DELHI: A man was sentenced to 10 years in jail by a fast-track court for raping a girl on the false promise of marriage and leaving her after she became pregnant.

The court said that after maintaining physical relations with the Muslim girl for over two years, Deepak Dogra refused to marry her. Moreover, to save himself from legal punishment, he went through "farce of marriage ceremony" despite knowing that it was neither lawful nor valid.

ASJ Nivedita Anil Sharma said that it is clear from the girl's evidence that a 'farce' marriage was conducted in a temple where the couple exchanged garlands and Deepak put vermilion on the girl's head knowing fully well that he is a Hindu and the girl a Muslim. Even after being told by a priest that the marriage can not be performed in that temple, Deepak still went ahead with the ceremony.

The 20-year-old girl was awarded a compensation of Rs 1 lakh under the Delhi Victims Compensation Scheme. The court imposed a fine of Rs 60,000 on Mubarakpur- resident Deepak stating that if realized, the amount should be given to the victim as compensation.

According to the prosecution, the girl had lodged a complaint against Deepak in October 2010 alleging that he had raped her several times in a factory and at her house after promising her marriage. But after she became pregnant, Deepak refused to marry her and even asked her to abort the child. When the girl approached police, Deepak told the cops that they were married and produced the photographs as proof. But the court said, "...Deepak is a Hindu and the girl is a Muslim. The two could not have married unless one of them converted to the religion of the other, or they got married under the Special Marriage Act."

Deepak was held guilty for raping and fraudulently performing the marriage ceremony. Regarding the girl's consent in having physical relations with the accused, the judge said that it was clear from her evidence that Deepak developed physical relations with her on the promise of marrying her.

The woman alleged that she was raped many times at her home and in a factory, but he left her when she became pregnant.

Feb 17, 2013: 75-year-old priest held for molesting minors

By Soumittra S Bose, TNN | Feb 17, 2013, 02.09 AM IST
NAGPUR: A 75-year-old priest was arrested for allegedly sexually abusing two girls aged 5 and 7 on Friday. A group of agitated women from Hazaripahad stormed the Gittikhadan police station on Saturday and demanded stern action against the accused Babulal Dwivedi.

The matter came to fore after one of Dwivedi's neighbours — the wife of a tailor whose shop is located across the temple — observed him sexually abusing one of the girls on February 8.

Four days later, on February 12, the stunned woman informed about the incident to a teacher of the school where the victim girls study. The teacher urged the 7-year-old victim to call her mother to the school and informed her about the incident. The student too corroborated what the eyewitness said.

The mother returned to the locality and spoke to the tailor's wife. The eyewitness also informed the aggrieved woman about another girl being victimized by Dwivedi.

The women initially approached a temple trustee over the issue but he — as the agitated women claim — tried to hush up the episode.

Priest sought alms from women

Babulal Dwivedi, temple priest, has been arrested after charges of sexually abusing minor girls were leveled against him. A temple trustee first tried to cover up the matter.

A group of irate women, along with some social workers of the area, then approached Gittikhadan police, who immediately rounded up Dwivedi.

It is learnt that Dwivedi would approach the girls waiting for school bus in front of the temple.

"On the day of incident, my daughter reached bus stop early," mother of the 7-year-old victim said. "The priest called her inside the temple on the pretext of giving her prasad. He then misbehaved with my daughter. She did not reveal fearing consequences," she claimed.

The mother of 5-year-old victim acknowledged that her daughter too was sexually abused by Dwivedi. "We want stringent punishment for the priest," she said.

Apart from the abused girls' mothers, some other women too came forth with complaints against Dwivedi. They alleged that Dwivedi used to deliberately visit seeking alms from women. "Such misconduct is not expected of a priest," said an elderly woman who had come to the police station to register her protest.

Former mayor and BJP corporator Mayatai Iwnate said that police should have charged the priest with rape.

Gittikhadan police station's senior police inspector CM Bahadure said that medical examinations of the girls do not suggest rape.

NEW DELHI: A six-year-old girl from Gurgaon was abducted, raped and brutalized on Sunday in reviving Kapashera, southwest Delhi.

The girl is admitted in Safdarjung Hospital with severe injuries to her private parts and lower intestinal region, and has undergone a few surgeries.

The girl was found on the roadside near Kapashera border around 10pm, said a police officer. A motorist found her lying in a pool of blood and crying. He informed the police, who rushed her to the hospital.

She was critical when she was brought in, said Dr B D Athani, the medical superintendent of the hospital. "Her intestines have been partially damaged, while her genitals had major injuries that required emergency reparative surgery," Athani said.

As her medical examination confirmed rape, a case was registered under IPC and Protection of Children from Sexual Offences Act. A joint probe by Delhi and Gurgaon police began, but there were no leads initially.

Fortunately, someone from the girl's family identified her. Cops then got to know that she had gone missing while playing outside her house around 7pm on Sunday. The family had looked around for her without any luck. They had then approached local police around 8pm and registered a missing complaint.

The probe so far has revealed that the girl was last seen with a man in his early twenties who was taking her towards Dhundahera village near Gurgaon.

The cops are now trying to trace the person on the basis of his description given by the witness.

Police have been unable to record the girl's statement so far and are planning to seek an NGO's help to find out more about the case.

A source, though, said that going by the circumstantial evidence, it appears that the accused maybe someone the girl knew. He has also cited the possibility of more than one person raping her.

The probe team is being led by SHO Mukesh Wali, while additional commissioner of police A K Ojha is in overall charge of the case.

Feb 13, 2013: 5-year-old found murdered, eyes gouged out

TNN | Feb 13, 2013, 04.47 AM IST
BANGALORE: A five-year-old girl was found murdered with gruesome injuries all over her body, including her private parts, at a construction site in Madiwala on Tuesday. The child's right eye had been gouged out. The elder daughter of a domestic help who had separated from her husband, the girl was last seen playing outside her grandmother's residence near Rotary Nagar, Kodichikkanahalli, Madiwala, south-east Bangalore, on Monday evening.

On returning from work, the mother found that her two-and-a-half-year-old daughter was at home, and the elder one was missing. The woman and her two children used to stay with the mother.

She and the grandmother searched the neighborhood and then an autorickshaw fitted with a public address system went around the area looking for the girl. Police suspect this act of public announcement proved fatal for the child as the kidnapper feared he might be identified if the girl got away from his captivity.

Madiwala police joined the search party and asked the mother to file a complaint. The mother reportedly said she would do so the next morning.

On Tuesday morning, walkers found the girl's body in a mud heap next to an under-construction apartment, about 700m from the child's house. The mother, along with the police, identified the body. "There were bruises on her body. There was a deep injury in the right eye and the eyeball had popped out. The swollen neck indicated she had been strangled," investigating officials said.

The victim's grandmother told the police that she usually picked up the girl every evening from a nearby anganawadi where she was in Class I. "I brought her home on Monday evening and went out for work. I returned home in the night and was told by my daughter that the child was missing," the grandmother, who also works as a domestic help, she said.

According to the victim's aunt, the girl never entertained strangers or accepted chocolates from anyone. "She was not fond of junk food or chocolates. Some known person has kidnapped her," she said.

The victim's parents separated a year ago. The woman and her two daughters shifted to her mother's house in Bangalore. The victim's father stayed back in Malavalli, Mandya, where he is a small farmer and a two-wheeler mechanic, family sources said.

Feb 8, 2013: Cops take Rs 2 lakh for airtrip to find missing daughter

PTI | Feb 8, 2013, 07.54 PM IST
JODHPUR: Rajasthan high court today directed that a case be registered against two police personnel, who took Rs 2 lakh from a man to fly to Karnataka to look for his missing daughter.

A division bench comprising justices Dinesh Maheshwari and Banwari Lal Sharma expressed grave disappointment over the conduct of the police and pulled up the two police officers present in the court after they admitted to the act.

The matter came to light during hearing today on a habeas corpus petition filed by Chail Singh, who approached the court after the cops returned empty handed from their trip.

Counsel of petitioner Mohd. Ali Rao said that Chail Singh's 15-year-old daughter had gone missing on the night of October 9 last year. He registered a missing person complaint with the Jalore police on October 13 against a man identified as Surendra Singh.

After some days, the investigating officer ASI Inda Ram approached Chail and told him that the police had got a tip off that his daughter was in Hubli, Karnataka and said that they can reach there only by air. Chail agreed to bear the expenses of the police for air travel to Hubli and handed over Rs 2 lakh to the police by mortgaging the jewellery of his wife, the counsel said.

After receiving the money from the complainant, the Investigating Officer boarded the flight with a constable and the sarpanch of village.

But police returned empty handed from Hubli after a few days and told Chail that his daughter could not be found in Hubli.

It also came to light that police did not mention the visit in the case diary, which had been called by the court today.

Expressing surprise over the manner in which the police had acted, the court directed theSuperintendent of Police (Jalore) to appear before it with case records on February 11 and register case against the erring policemen.
