Jan 18, 2013: Instead of pain-killers, hubby gives abortion pills

By Alka Panse, TNN | Jan 18, 2013, 02.21 AM IST
NAGPUR: On a complaint filed by Priyanka, the Pachpaoli police have booked her husband Prabhakar Ubade, 42, for allegedly cheating and causing her to miscarry without consent. The 22-year-old woman was 12 weeks pregnant.

Priyanka claimed that Ubade cheated by giving her abortion pills instead of painkillers. She told TOI that Ubade had also lied to her about her relationship with Indira who was his late brother's wife. "He said he wanted to take care of his brother's four kids and hence was staying with Indira. Actually, he was having an affair with her."

Being neighbours in Imambada, Priyanka and Ubade fell in love. He even promised Priyanka's family that he would give them money to buy a television on instalments. Ubade soon proposed marriage to her.

"On June 6 last year, Ubade took me to Koradi temple and we got married the same day. Two of his friends, Gayatri and Raj were witnesses before the priest. After the marriage, we even rented a house and everything seemed fine," said Priyanka.

However, her happiness lasted only for a month. In July, Ubade's family came to know about his marriage to Priyanka and forcibly entered their house. "They abused me, beat me up badly and threatened me too. They wanted me to leave Ubade," she said.

Strangely, Ubade chose to go along with his relatives. A hapless Priyanka then complained at theAjni police station. On being questioned by the police, Ubade promised to provide maintenance money for Priyanka and convinced them to not take any action. It was decided that for a few months Priyanka would stay at her sister's house in Nashik and Ubade with Indira in the city.

In August, Ubade and his friends went to Nashik and convinced Priyanka to return to him. "He suggested we marry again legally. This time, we got married in a court in the presence of my parents," she said.

This time, Ubade and Priyanka rented a house in Pachpaoli. Soon, Priyanka learnt about her pregnancy.

Happiness continued to elude the couple as Indira landed up at their house again. "Again, I called the police and Ubade assured them that he would stay with me," said Priyanka who had become weak due to the tension and had to be hospitalized many times.

On December 14, Priyanka suffered some pain and asked Ubade to take her to a doctor. "He came after a few minutes and told that the doctor was not available but he had bought some pills to reduce the pain. The pills were covered in white paper. I trusted him and gulped the pills but after a few hours, I came to know that it was for the termination of my pregnancy," told Priyanka.

Priyanka said that since she was bleeding, Ubade rushed her to a hospital immediately. While Priyanka was hospitalized for two days, Ubade, vacated their rented room.

"I spoke to him after being discharged and he rudely said that he had left me. This time, I decided to file a police complaint," said Priyanka.

Priyanka alleged that twice she had gone to file a police complaint, first at Imambada and then at Ajni, but was sent back. Her parents claimed that the complaint was filed only after they approach city police chief, KK Pathak.

Sep 29, 2012: Woman booked for trying to dispose female foetus

, TNN | Sep 29, 2012, 03.58AM IST
NOIDA: In a case of suspected illegal abortion, the Gautam Budh Nagar district hospital has lodged a complaint with the Noida police against a woman for allegedly trying to dispose off a five-month-old female foetus. The woman was apprehended by the chief medical superintendent of the hospital on Friday afternoon when she was about to throw the foetus, which was wrapped in an old newspaper, into the dustbin. Hospital authorities suspect that diagnostic centres around the hospital are conducting unauthorized pre-natal sex determination tests as several women have come to the hospital for abortions in the recent past.

The incident occurred around 2.15pm when the medical superintendent, Dr Ashok Mishra, was leaving the hospital after his day's work along with his wife, Dr Meena Mishra. "We suddenly spotted a woman hurrying towards the exit gate. She was carrying a newspaper-wrapped parcel. My wife questioned the woman, Reshma and found the packet stained with blood. Reshma said she was carrying soiled clothes and was going to dispose them," Mishra said.

The CMS added that they found out that her sister-in-law, Saba, was admitted in the hospital's labour room. When they examined the packet they found that it contained a dead female foetus.

Meena Mishra, a gynaecologist at the district hospital, said Saba had consulted her two days ago and requested for an abortion. "I refused as the foetus was 5 months old. When I confronted Saba again when I took Reshma to the labour room and examined her, the foetus was no longer in Saba's womb," Dr Mishra said.

MUMBAI: A 28-year-old man was arrested by the Nehru Nagar police in Kurla for allegedly raping a teenager and later forcing her to abort their child. The police have also booked the doctor who had carried out the abortion at his clinic in Saki Naka, Andheri.

The accused, Arjun Dhere, is a resident of Shramjeevi colony in Kurla (E). He met the 19-year-old victim through a common friend. The girl is a resident of Saibaba Nagar in Kurla (E). Dhere got into a physical relationship with the girl after promising to marry her. The girl later discovered she was pregnant and informed Dhere, who refused to tie the knot with her. "On Friday, the girl left her home and did not return. Her parents registered a missing complaint with us on Saturday," a police officer said.

The girl returned home by Saturday night. The police quizzed her about her disappearing act and learnt that she had gone to a clinic after being forced to abort her three-month-old baby. The abortion was reportedly carried out at a clinic in Saki Naka.

The girl's parents then registered a case against Dhere. The police arrested him under sections 376 (rape), 315 (act done with intention to prevent child being born alive or to cause it to die after birth), 201 (causing disappearance of evidence of offence or giving false information to screen offender) of the Indian Penal Code.

Dhere has been remanded in police custody. The police refused to disclose the name of the doctor. "We need to find out the extent of the doctor's involvement in the case. We will check documents related to his registration," senior inspector Dhananjay Bagayatkar said.

Abortions are termed legal only when performed by a medical practitioner approved by the Medical Termination of Pregnancy Act. The abortion must be carried out at a place approved under the Act. Pregnancies can be terminated up to 20 weeks gestation.

Jun 11, 2012: HIV positive rapist dad charged with attempt to murder

PTI | Jun 11, 2012, 05.44PM IST
NEW DELHI: An HIV positive man, who allegedly raped his minor step daughter infecting her with the life threatening disease, has been put on trial by a Delhi court on attempt to murder charges, besides that of raping her.

Additional sessions judge (ASJ) Kamini Lau framed charges of rape and attempt to murder against the accused step father saying he had "intentionally" transmitted the deadly disease knowing fully well that it is likely to cause death of his 15-year-old daughter.

Lamenting the lack of a special legislation to deal with such situations, the court said such accused are liable to be prosecuted for the offence of attempt to murder and also charged him with causing miscarriage of his step daughter by giving her medicines.

"Unfortunately, there being no special legislation to deal with such situation of accused transmitting life threatening decease to another person intentionally with knowledge that the same is likely to cause death of that other person, this court is of the opinion that under the given circumstances, such person is also liable to be charged for the offence under section 307 (attempt to murder) of the IPC," it said.

The accused has been charged under sections 376 (rape), 307 (attempt to murder) and 313 (causing miscarriage without woman's consent) of the IPC.

While framing the charges, the court also referred to the medical report of the accused which said he is a known HIV positive case and at present his condition is satisfactory and stable.

Besides the step-father, the court also framed charges of rape against co-accused and victim's boyfriend Ashutosh Maurya saying he too raped the girl at her house in Shalimar Bagh village here between April 2011 to August 2011. city lead.

, TNN | Jun 6, 2012, 05.30AM IST
CHANDIGARH: A panel probing cases of sexual abuse at Rohtak's Apna Ghar shelter home has found that its caretaker used to allegedly abort pregnancies of women living there by inserting sticks into their private parts besides hitting them, sources said.

They said that the name of a Rohtak hotel surfaced during the investigations, where girls were sent "almost daily for VIP customers".

The sources said the caretaker, Jaswanti Devi — abetted by her son-in-law — did not even spare mentally challenged girls. "She used to drug mentally challenged girls before pushing them into sexual exploitation and many cops were regular visitors. The girls were even forced to sleep naked in winter," a source said.

The Punjab and Haryana high court had constituted the four-member team to look into the allegations of torture and abuse and directed it to interview women living there, besides recommending those who would need medical examination.

May 17, 2012: Kasturba Gandhi Balika Vidyalaya girl student critical after being raped by teacher

, TNN | May 17, 2012, 05.35PM IST
LUCKNOW: A 14-year-old girl, student of Kasturba Gandhi Balika Vidyalaya in Unnao, was admitted in a critical condition at gynaecology department of the CSM medical university, Lucknow. The girl got pregnant after being raped by a school teacher about two months back. She was bleeding heavily after being forced to take an abortion pill. Parents were unaware of the rape and pregnancy till they reached Lucknow where doctors informed them the reality. The parents later lodged a complaint with the police which has arrested the teacher and the woman cook of the school who forced girl to take the pill.

"The school authorities called us a few days back and informed that our daughter is not keeping well. We brought her home and when bleeding did not stop, we took her to local hospital, which referred her to Lucknow. Here we came to know about the abortion attempt. And, then he girl told us the whole story," said victim's father. The doctors at CSM medical university's gynaecology department said that the pill given to the girl has damaged her uterus. The girl, they said, has also lost a lot of blood and developed some complications. The police have not ruled out the possibilities of more victims in the school.

Run under Sarv Shiksha Abhiyan, a central government funded scheme, KGBVs are free residential schools for dalit and below poverty line girls who dropout after primary schooling. It caters to grown up girls (14-16 years) who cannot go back to regular school. There are around 500 KGBVs in UP. Of total, 350 odd KGBVs are managed by district committees formed by state government. Others are run by non-government-organisations (NGOs) and the semi-government organisation Mahila Samakhya. The condition of KGBVs run by the NGOs and theMahila Samakhya is better than those under state government.

This is not the first incident where girls in a KGBV have been sexually exploited. In fact, a few days back, girl students of KGBV in Azamgarh had lodged complaint against the school guard and cook of sexual harassment. Both the accused were later arrested and sacked. Rashi Singh, a social activist, said that many cases of sexual abuse are not reported by the girls fearing that it could bring bad name to their family." "We have also found that girls are being subjected to misbehaviour by school officials and anomalies like poor quality food, lack of space, shortage of staff, inadequate study material," she added.

Not only in KGBVs, girls are also be sexually abused in orphanage in the state. About a month back, three minor girls were raped by peon in Rajikiya Shishu Grih, orphanage run by the government, for children below 10 years of age in Allahabad. The victims are said to be between 7 to 9 years of age are were subjected to physical and mental trauma for last few months. However, the matter came to light when one of the girl disclosed everything to a childless couple who wanted to adopt her. The couple informed the authorities. Later inquires found two more victims. Medical examination confirmed rape.

Apr 23, 2012: Forced into abortion 6 times, woman turns whistleblower

, TNN | Apr 23, 2012, 02.34AM IST
AHMEDABAD: She was forced to go for abortion not once but six times by her in-laws as they were obsessed for a male heir. Today she has used RTI to rescue several women who go through this ordeal many times in their lives. Amisha Bhatt, 36, from Vastrapur has exposed errant sonography clinics, how despite laws like Pre-Conception & Pre-Natal Diagnostic Techniques (PCPNDT) Act and measures to prevent sex determination tests doctors have been maintaining a secret list of patients who are being sent by in-laws for abortions. This list is never revealed to the state government. In her RTI Bhatt has exposed this practice in clinics located in Anand, Anand, Vadodara and Panchmahals.
Bhatt had already filed a police case against her husband and in-laws for harassment. But in order to expose this practice Bhatt filed RTI applications with the health officers of two districts seeking details about her abortion case and other such cases. The explosive information exposed a nefarious nexus between gynecologists and sonography clinics involved in illegal abortion and sex determination tests. Bhatt found that her name did not figure in the elaborate list of patients who had undergone sonography tests.
"This meant that the government had no information on the tests conducted on me, as mandated under the PCPNDT Act. There may have been many such women like me. The doctors were maintaining a secret list of patients on which sex determination tests were being conducted," says Bhatt.
Due to Bhatt's expose, licences of two doctors' were cancelled for malpractice and the state government reviewed the requirements for doctors to submit their monthly reports.
Bhatt married Priyavadan Bhatt, a resident of Anand, in the year 2000. Between 2001 and 2009, she was subjected to six abortions. She even gave birth to Kamya, a girl child. Bhatt was sent to clinics in Anand, Vadodara and Godhra.
Rajendra Shukla of Yogkshem Manav Sansthan, a city-based organization, who helped Bhatt, says, "The records revealed an ugly truth. Bhatt's name was not mentioned in the monthly reports sent to the health officers. We proved the abortion and sonography with help of the bills of the doctors. The form 'F' for sonography did not have signature of Bhatt, a prerequisite. We submitted the proofs to the health officials and blew lid off the scam," said Shukla.

Apr 18, 2012: Placement agency owner held in rape-abortion case

, TNN | Apr 18, 2012, 02.38AM IST
NEW DELHI: A placement agency owner was arrested on Tuesday in a human trafficking case where an 18-year-old woman was raped and forced to get an abortion. The main accused Rajesh who allegedly raped the woman, co-owns the placement agency in Sarita Vihar. He has been on the run since December.

Police is on the lookout for Rajesh and also Kunti, who allegedly got the young woman to Delhi. The doctor who allegedly performed the abortion is also being questioned, said sources.

Meanwhile, the Child Welfare Committee of the area has also taken cognizance of the matter on its own. The CWC has asked why the victim had not been produced in front of the committee till now.

The accused Raj Kumar was nabbed from Malviya Nagar in south Delhi where he had come to meet one Pancham, another accused in the case and also a placement agency owner, said sources.

Sources said Raj Kumar claimed during interrogation he had only facilitated the abortion and not raped the girl. Police sources said that Raj Kumar told them that he already has two cases of rape lodged against him. He claimed he had not raped the 18-year-old maid and was managing the agency after Rajesh disappeared.

While working in Faridabad, the woman complained of stomachache and vomiting one day. Her employer contacted Raj Kumar and she was called back. The woman told Raj Kumar that she may be pregnant.

Raj Kumar told cops that his friend Pancham then told him about a lady doctor in Madangir.

The pregnancy was confirmed and the victim was taken to a nursing home in Saket where her foetus was aborted. Acting on a tip-off, NGO Shakti Vahini informed police about the incident. The girl was rescued, but Raj Kumar fled.

Many illegal and unlicensed placement agencies in the capital, a police source said, are part of an organized trafficking racket involving women and children. They coordinate with doctors/quacks who come in handy when any girl gets pregnant. The same happened in this case too, said the source.
