Teen gets 10-yr jail for raping 80-yr-old

Indo-Asian News Services, Updated: Jan 31, 2012 22:17 IST
New Delhi: A Delhi court on Tuesday wanted the legislature to redefine the offence of rape while sentencing a youth to ten years in jail for assaulting an 80-year-old woman last year.

"This case sounds a wake-up call for Indian legislators to step in and think about having a re-look at the definition of rape so as to specifically include the instances of digital rape/male rape and make the offence gender neutral or to formulate a separate exhaustive legislation covering all categories of cases of sexual assault similar to legislations abroad," said Additional Sessions Judge Kamini Lau.

The court, which convicted the youth for committing the offence of unnatural sex, termed the assault of the destitute old woman as an incident covered in the category of "digital rape" and sought recasting of laws to include such incidents.
Such offences be made "gender neutral", it said while holding 19-year-old Pahlad guilty of abduction, forcing the woman into an illicit intercourse against the order of the nature, attempt to murder and digital rape.

Terming the case as an "eye opener", the court said it was time for the legislature to take a serious note of the extent of depravation which exists in Indian urban society, victims of which are usually children and senior citizens being easy targets.

The judgement came in a case of "digital rape" of an old woman by Pahlad on the intervening night of May 19-20 last year when she was sleeping in a shed in a park at Tri Nagar here.

The convict asked the victim to accompany him. On being refused, he forcibly took her to bushes in a nearby park and sexually assaulted her with a wooden stick.

The police said the elderly victim had been abandoned by her family and she used to live in Tri Nagar where local residents who used to give her food.

It said that on the following morning after the incident, some passerby saw the unconscious woman in a critical condition and took her to the hospital.

The court said there is a need for a re-look at the existing law and for inclusion of "digital rape" within the definition of rape.

"There is growing demand the world over for inclusion of digital rape/male rape within the definition of rape and the fact that it is cases like the present one which sometimes reflects the institutional helplessness in appropriately dealing with the crime on account of the lag in law," it said.

It also directed Delhi government to pay a compensation of Rs 50,000 to the victim who is living in an old-age home at Dwarka and directed the amount should be used for her welfare as she requires constant medical assistance.

The judge said the penal provision for unnatural offence, to a large extent, cover cases of offence committed against order of nature but technically its applicability was limited and by operation it becomes difficult to include certain category of cases where the offence has been committed by the offender with an object.

"It is only to cover all kinds of penetrations without a person's consent in any manner that the need for a re-look at the existing laws has been necessitated," the court said.

It said the cause of such sexual assault could be the "X-rated material easily available in market and on internet".

Mumbai: The victim went missing from the vicinity of her house in the night, was spotted entering the area in the morning in a horrific condition; cops have registered a case of kidnapping and rape
The Govandi police have launched a manhunt for an unknown person accused of kidnapping and raping a minor.
The girl (7), a resident of Baiganwadi in Shivaji Nagar, had accompanied her grandmother to fetch water, when the unidentified person abducted her from the locale on Sunday night.

Yesterday at around 6.30 am, the girl was seen walking in to the area crying and her clothes were torn and stained.

A medical test conducted at Nagpada Hospital confirmed that the girl was raped. Police have, however, not managed to get a statement from the traumatised victim as she is currently under observation at JJ Hospital.

According to the cops, on January 22 at around 10 pm, the victim studying in class II, followed her grandma to the common tap to fill water, which is located a few metres away from their house.

Claiming that he was their neighbour, an unknown man aged between 20-25 years, and clad in a green shirt and black trousers, approached the grandmother and started conversing with her. But she told him that she didn't know him. The man, however, insisted that she was known to him and hung around. As there was another bucket of water to be filled, the grandmother asked the man to keep a watch on the girl till she returned.

When she returned after 10 minutes, the man and her granddaughter were nowhere to be seen. She enquired of some locals, who had seen the man talking to her and assumed that she knew him.

After learning that the man was not from the area, hell broke loose. The police were informed, as the locals started their own search operation. A massive hunt gripped the whole area, which continued through the night, but to no avail.

Around 6.30 am, the minor was spotted entering the area. Her clothes were torn and tattered and she was in a state of shock, unable to communicate.

We have also called in a sketch artist, and with the help of the grandmother and the eyewitnesses, we are trying to sketch a portrait of the unknown accused," said Radhesham Agarwal, senior police inspector at Shivaji Nagar police station.

The court sentenced Bahadur to life imprisonment and fine of Rs 25,000 for the offence under section 376 (rape) and jail for five years and fine of Rs 5,000 for the offence under section 506 (criminal intimidation) of IPC. The court said both sentences would run concurrently.

"We received a tip-off yesterday that a sex racket was operating in Madhu Vihar. A decoy was sent who met Anand. The pimp took him near a Hyundai Accent car where a pimp using the alias of Sonu Bangalan was present along with four girls.

"A deal was struck for Rs 7,000 and part payment was made to them. After this, a raid was conducted and six were arrested," DCP (Crime) Ashok Chand said.

The woman pimp, hailing from West Bengal, was residing at Madhu Vihar. Anand was earlier a driver in a call centre and came in contact with her. Both had been running the call girl racket for the last three years, Chand claimed.

"They operated in the Trans Yamuna Area. In order to avoid detection, they kept changing the places from where they operated. They have operated from Patparganj, Ganesh Nagar and Vinod Nagar.

"The recent place in Madhu Vihar from where they operated had been taken on rent for the last seven-eight months on a monthly rent of Rs 8,000. The call girls are generally in the age bracket of 19 to 30 years," Chand said.

Jan 18, 2012: 3 held for murder, gangrape of child

TNN | Jan 18, 2012, 04.14AM IST
NEW DELHI: Three men have been arrested for the gangrape and murder of a four-year-old girl in west Delhi. The accused have been identified as Jagvir (30), Rajkumar (24) and Birbal (26).

On January 5, Jagvir alias Jawahar, a labourer, kidnapped the child from her residence in Ramesh Nagar. The victim's father is an overseer and Jagvir had worked for him earlier.

"Jagvir took her to an under construction building in the area, where the other two accused were waiting for him. The three took turns to rape the child. They then throttled her and dumped the body in a nearby drain. Passersby spotted the body next morning and informed police.

After identification, the body was sent for postmortem. As sand and dirt was found on the body, cops inferred the rape must have taken place at some construction site in the area. Over 150 labourers from the area were questioned and cops found that Jagvir had been missing. Raids were conducted in Delhi and Bihar, and the trio was arrested,'' said a senior investigating officer.

The police said that the accused had murdered the girl as they feared that she may identify Jagvir later. The investigating officers said the blood-stained clothes of the child were recovered after the accused were interrogated. "We are now recording the statements of other labourers at the site to develop circumstantial evidence,'' said a source.

Last year, there was a significant rise in the number of rape and molestation cases in the city compared to 2010. While rape cases rose to 568 in 2011 compared to 507 in 2010, there were 653 cases of molestation in 2011 compared to 601 reported the previous year.
