Mar 29, 2012: Cops rescue girl 'sold by parents'

TNN | Mar 29, 2012, 01.47AM IST
KOLKATA: The Kolkata Police's detective department rescued a 17-year-old girl from Sonagachhi on Wednesday.
The girl, who had allegedly been forced by her parents to join the flesh trade, somehow managed to contact an NGO working in the area. The NGO officials informed police who arrested the girl's parents and are looking for two other women.
Police said the girl hails from Bhopal in Madhya Pradesh and was brought up by her grandparents. A Class VII dropout, the girl did not suspect anything amiss when her parents, Nabab Singh and Bina Singh, brought her to Kolkata, promising to send her to school. Police said that's how she landed up in the city around six months ago.
But she was in for a rude shock when her parents allegedly sold her to a pimp at Sonagachhi. She was confined in a house owned by two women, Geeta Devi and Rajeswari Devi. She was allegedly tortured when she did not agree to join the flesh trade. Police believe some members of her family are involved in the trade.
A week ago, the girl somehow managed to collect the phone number of an NGO dealing with such distressed girls. "She got the number from one of her clients," said an investigator. The NGO soon found her out and informed police. Officers of Immoral Trafficking section of Kolkata Police raided the house on Tuesday night and the girl was rescued.
After recording her statement, police rounded up her parents. But shortly before the raid, the two women who bought the girl and confined her in the house managed to escape. "The girl is still traumatized. She will be sent to a government home," said an officer.

Mar 29, 2012: Man throttles wife to death at Guruwar Peth residence

TNN | Mar 29, 2012, 03.06AM IST
PUNE: The Khadak police on Wednesday arrested a 35-year-old man for killing his wife on Wednesday morning.
The man, Vikram alias Vicki Malhari Rasale, a resident of Excel Apartments in Guruwar Peth, allegedly throttled his wife Swati alias Rani (27) to death. The police also found several bite marks on Swati's body.
Assistant commissioner of police Ranjit Dhure told TOI, "We suspect Vikram may have hit Swati's head against the wall. A portion of the bed under her head was soaked in blood. There were blood marks on the wall of the bedroom too." He added that the police were waiting for the post mortem report.
Vikram works as a milk supplier. His father is a retired police officer and his brother a police naik with the Pune police.
Vikram, his wife, their five-month-old daughter and parents lived together in the flat. Vikram and Swati had been married in 2010. In October 2011, they had twins but the baby boy died from an ailment. "His family told the police that since then, Vikram had been disturbed. However, he had never been violent," Dhure said.
For the last week or so, Vikram had been convinced that someone had done black magic on him and was trying to kill him. He would not leave the house on his own. Dhure said that on Tuesday night Vikram told his brother Sanjay not to leave him as someone would kill him. Seeing Vikram's condition, his parents called their son-in-law Hanmant Shinde to talk with him. Sanjay Rasale left the house after Shinde arrived. "Vikram then took Shinde and Swati into the bedroom of the flat and locked it from inside," Dhure said.
Dhure said that they stayed awake all night as Vikram was still afraid that he would be killed. "Around 7 am on Wednesday, Shinde managed to get out of the bedroom as he had to go to work. Vikram however, did not come out and did not allow Swati to come out either," Dhure said.
Vikram's parents tried to talk to the couple but with only Vikrant answering, they called up Sanjay as well as Swati's parents. "All of them tried to convince Vikram to come out of the room but he did not open the door," said senior police inspector Rajendra Kadam of the Khadak police station.
Kadam said that the family members then informed the police. A police team reached the flat and broke open the door. "When we entered the room, we found Swati unconscious and Vikram sitting near her," Kadam said.
A doctor was called and he declared Swati dead. "There were bites on her body. Vikram had bitten her on her left hand, her left ear, on her chin and on the stomach," Kadam said.
Vikram was arrested under section 302 of the Indian Penal Code for murder. "Vikram told us that he had throttled his wife. We are investigating further," Kadam added.

Mar 29, 2012: Robbers kill farmer, rape his wife

, TNN | Mar 29, 2012, 01.45AM IST
POLBA (HOOGHLY): Less than 24 hours of a woman being raped by robbers in South 24-Parganas' Canning, a gang of four murdered a wealthy farmer in Hooghly's Polba around midnight on Tuesday, raped his wife before fleeing with valuables.
Patna village, where the incident took place, is around 60 km from Kolkata. The woman was sent for a medical examination after she broke down and narrated her ordeal before senior police officers.
Krishna Chandra Mal, 50, who owns around 25 bighas of fertile land, lived with his 40-year-old wife and teenaged son. Around midnight on Tuesday, he left his bedroom to go the toilet, which is located outside the main building. His wife followed him outside. As soon as Mal opened the courtyard door, four men allegedly pounced on him. Two of them pinned him down while the rest turned their attention to his wife. Before she could get over the shock, she was gagged and trussed up. The goons pushed her into a room.
The men then entered the room where Mal's son Kushal, 14, was asleep. They gagged and tied him up before starting to loot valuables from the house. By then, Mal had managed to break free from his captors and rushed towards the house. At this point, one of the miscreants pulled out a dagger and slit his throat. After Mal fell on the ground, he was stabbed repeatedly.
"Even as Mal bled to death in the courtyard, the criminals entered the room where his wife was confined. According to the woman, the men abused her sexually before leaving with the valuables they had looted. After some time, Kushal succeeded in freeing himself and went to his mother's help. Mal had died by then. The two then raised an alarm," a police officer said.
On Wednesday morning, a large number of villagers led by Trinamool Congress leaders gheraoed Polba police station, demanding arrest of the accused. Initially, a case of murder and robbery was registered at the police station. Later, when additional SP Ashis Biswas reached the village, the woman broke down and told him that she was raped. She said she decided to break her silence after receiving support from the villagers. She was sent to the Imambara Hospital in Chinsurah for a medical examination.
"Before leaving, she spoke to us but could not say why somebody would want to kill her husband or rape her. Mal had sold the potatoes he had grown some time ago and deposited the money in the bank. His wife told us that he had obtained a tractor on hire-purchase recently. Some EMIs are still pending and Mal had allegedly received some threat calls in this regard. We shall look into this angle," the officer added.
Barely a month ago, a widow from Polba was lured by a relative to a place where some miscreants were having alcohol and raped. Four persons have been arrested in that case.
"We have got some clues and are investigating the matter. We hope to make a breakthrough soon," Biswas said.

Mar 28, 2012: Infant girl found dead in dustbin

TNN | Mar 28, 2012, 07.18AM IST
JAIPUR: While the thrust of the government is on sex determination to check dismal child sex ratio in the state, the frequent cases of dumping infant girls seem to have escaped the concern of the government and there no pro-active measures to curb the menace.

On Tuesday, the natives of P&T colony in Shastri Nagar area informed the police about an abandoned infant girl in a dustbin, but it was too late. "We took the girl to Kanwatia hospital and the doctors declared her brought dead. She was probably born on Monday and her body was dumped in the garbage bin in the night," an officer said. The girl seems to have been strangulated.

According to the police, the girl was probably born on Monday and her body was dumped in the garbage bin in the night.

The girl's post mortem was done at the Kanwatia hospital, police said, adding they were awaiting the report to find the actual cause of death of the girl. However , it seems she was strangulated as there were marks on her neck.
In most of the six cases in which infant girl children were found abandoned since 2009, the city police just did a formality of post mortem and the deceased was buried.

What actually stops the Jaipur police to treat such cases as murder, when asked, a senior police officer, on the condition of anonymity, said, "In most of these cases neither the locals of the area where the body is found nor the concerned nursing homes where the baby is born are willing to cooperate with us, which would give us some clues. Likewise, it is mandatory for nursing homes to register every birth but in many of the cases it is not complied with."
"I think the state government is showing its concern for the feticide but the police and medical department is not doing the required drill to check the female infanticide ," said Kavita Srivastava, general secretary, PUCL, Rajasthan.

"In some of the districts including Sikar where 12 infants were found dumped in wells, the police did a nice investigation However, in Jaipur it appears that the police are not serious towards checking the cases where unknown persons dump the infants (girls)," she added.

According to the UNICEF reports in Rajasthan there were 914 girls per 1,000 boys in 0-6 years category while for urban population there were 887 girls in 1000 boys. The figures of the 2011 census show a marginal improvement but not satisfactory as there are 932 girls per 1,000 boys in rural areas while there are 911 girls in urban population per 1,000 boys.

Mar 27, 2012: Robbers gang-rape, shoot woman

, TNN | Mar 27, 2012, 07.17AM IST
PATNA/JAMUI: In an incident that sent shivers down the spine, road robbers gang-raped and shot dead a woman in her 30s after relieving her family members of cash and belongings while they were on way to Jamui after a picnic trip on Sunday evening. Worse, policemen took 12 hours to lodge an FIR as they allegedly fought over the jurisdiction of the place of occurrence.

The incident occurred at the tri-junction of Jamui, Sheikhpura and Lakhisarai districts, 200km from Patna, when Naresh Barnwal, a businessman based in Dhanbad, along with his wife and child and wife's brother, wife and child was returning after visiting tourist spots in Rajgir and Nalanda on his car.

They were on way to Jamui where his wife's 'mausi', or mother's sister, stayed.

Reports reaching state police HQ said the Barnwals were intercepted by six armed criminals who had put up boulders on the road near Hansapur village under the Karandeh police station of Sheikhpura district. They snatched the cash, ornaments, cellphones and other belongings of the Barnwals and pulled Naresh's wife out of the vehicle. They forced her to walk with them at gunpoint for some distance, gang-raped and shot at her before escaping.

Wailing family members scouted for the victim and took her to the Jamui sadar hospital, 50km away, where she was declared 'brought dead'.

Since the robbery took place at a spot that fell under Sheikhpura district; the gang rape at a spot in Lakhisarai district and the death was confirmed in Jamui district, cops at the three police stations concerned made the wailing Barnwals to run in circles - from Jamui to Sheikhpura and then to Lakhisarai.

What added to their woes was the fact that the SPs of Sheikhpura and Lakhisarai had relinquished the charge following a police reshuffle notified on Saturday.

It was only after the new incumbent, Premlata, joined as Lakhisarai SP on Monday and visited the spot along with new Sheikhpura SP Anusuiya Rana Singh Sahu that the FIR was lodged at the Halsi police station in Lakhisarai around 9am.

DGP Abhayanand said doctors performing autopsy informally told the local sub-inspector there were no signs of rape on the body. "However, we will wait for the autopsy report before reaching a conclusion," he said and added a team of forensic experts had been sent from Patna for scientific examination of the spot.

Sources said police have seized a cellphone from the spot. However, it was not examined till reports last came in on Monday evening.

Mar 26, 2012: Man jailed for slapping false case

TNN | Mar 26, 2012, 05.12AM IST
NEW DELHI: A man has been sentenced to one month jail term by a trail court for falsely implicating his daughter's lover in an abduction case as he did not approve of their inter-caste union and forcibly got his daughter married for a second time.

The case pertains to a recent incident of a runaway girl who went missing from a remand home and it was later discovered that she was remarried at the behest of her father, Kaushal. Kaushal had deposed before the court that his daughter was a minor and had been kidnapped by her lover, Prem Raj. However, the girl surfaced along with her lover and told the court that she was 20-years-old.

Holding Kaushal guilty of filing a false case, additional sessions judge Kamini Lau said, "This is a classic case exhibiting the manner in which the existing law and rules of procedure have been abused, misused and twisted by Kaushal (complainant/ father of the girl) only to frustrate her marriage with Prem Raj for the sole reason that he belonged to a low caste while she belonged to a high caste."

"...The entire system was used and abused by Kaushal to achieve his object of frustrating the marriage of his daughter with the accused... where on the one hand she continues to be the legally wedded wife of Prem Raj and on the other hand now resides with Son Pal Singh (the person with whom Kaushal had married her) as his wife," the court stated.

Mar 26, 2012: Woman holds down husband as lover chokes him to death

Mid-Day.com, Updated: Mar 26, 2012 12:43IST
Mumbai: Unhappy in her marriage, a 25-year-old housewife decided to end her husband's life with the help of her lover and his friend. Sangita Chandrakant Varak, a resident of Chembur, watched her husband Chandrakant die as her lover strangled Chandrakant's throat by stepping on it. Sangita and a friend of her lover held on to Chandrakant's hands and feet, as he struggled and fought for his life.

The RCF cops arrested Sangita, her lover Ramchandra Shelke and his friend Ramesh Bawdhane on Saturday after almost a month of investigations. According to the authorities, Sangita was having an affair with Shelke for over a year and her husband was aware of her infidelities.

Realising the marriage was not working, Sangita came up with a plan to end Chandrakant's life with the help of Shelke and Bawdhane on February 7. "Finally on February 10 at midnight, executing her plans, Sangita and Bawdhane held her husband's hands and legs while he was in bed and Shelke pushed his leg on Chandrakant's throat till he was unable to breathe any longer," said an officer.

The authorities added that they found Chandrakant's body at his home in Mapwali Chawl, Anik Gaon, Chembur.
Initially, they had registered a case of unnatural death. However, they were unable to find any evidence of murder and the post mortem did not provide any clues.

Cops received a breakthrough in the case, when Sangita kept offering different statements, which raised their suspicions. The doctor also said that Chandrakant was killed through strangulation. "Finally we were able to arrest the three on Saturday. The accused have confessed to their crimes," said C S Yadav, senior inspector, RCF police station.

Mar 25, 2012: Mother of tribal rape victim shot dead for not withdrawing complaint

TNN | Mar 25, 2012, 11.23AM IST
BHOPAL: The mother of a minor tribal schoolgirl who was raped in Betul two weeks ago, was shot dead by the alleged rapist and his cronies, in Betul on Friday. She was reportedly killed for refusing to withdraw the complaint that she had lodged with the police, after her daughter studying in class VII was savaged on 10 February.

The 50-year-old woman was shot right in front of her family by four men who had barged in to her home. Her daughter later told police that the four included her supposedly absconding rapist.

The four had stomped in to Imarti Bai Dhurve's home at Hamlapur on Friday night, ordering her to withdraw the complaint, which she reportedly refused . The men, identified by the police as the rape-accused Rajesh Kirar, Raju Yadav alias Bantu, Montu Yadav, and Praveen, reportedly had a heated argument with her, before she was shot. Her traumatized daughter, who was present there, said they shot thrice and her mother fell dead.

She said the alleged rapist had been threatening her mother for the last couple of days, asking to take back the rape complaint filed at the Gani police station. Fearing the worst, her family had approached the police a couple of times - but the cops, apparently, did nothing.

The girl was going to her school when she was allegedly abducted by Rajesh Kirar and a lady, identified as Rani, wife of Mantu. Rajesh had allegedly taken the girl into a room and raped her.

Rani was arrested and produced in a local court, which let her out on bail, according to Betul's Additional Superintendent of Police (ASP) M L Solanki.

The ASP claimed to TOI that indications were it was Montu who had shot the woman, through her back. The ASP maintained that while her daughter stated to the cops that the alleged rapist was among the four men, her brother had denied that. Imarti's husband Shyam was sitting on a cot outside, when the men entered his home and shot his wife dead, according to Solanki.

The accused have been charged with murder, besides under the SC & ST Atrocities Act.

The ASP also claimed that the dead woman had not approached him about the threats she had after lodging the rape complaint. ``We would have lodged another case against the accused if she did,'' he said.

Anyhow, none of the four men have been arrested as of Saturday evening, more than 24 hours after the murder.

Mar 25, 2012: Semen presence not necessary for proving rape: High court - The Times of India

, TNN | Mar 25, 2012, 01.22AM IST
NAGPUR: Rejecting an appeal filed by a rape and murder accused, the Aurangabad bench of Bombay High Court has ruled that presence of semen is not necessary for proving offence of rape. "It is not necessary that in every sexual intercourse, there would be oozing of semen," a division bench comprising justices Naresh Patil and TV Nalwade ruled.

In the process, the court upheld the Osmanabad sessions court verdict which sentenced Prashant Kate (25) to death and lifer for raping and killing a six-year-old girl. He was also slapped with a fine of Rs 25,000.

Citing Section 375 of IPC, the court ruled that even slight penetration is sufficient to constitute the offence of rape. "In the present case, reason is given that there was no semen detected in vaginal swab. It is not acceptable in view of position of law and also for common sense," the court observed.

"There is sufficient evidence to prove that it is a case of homicide and rape. It needs to be observed that no injury was found on the private part of the accused, but we cannot infer from it that he had not committed rape," the court added.

Citing criminal analysis report, the accused contended that his blood group was 'O' while that found on the clothes of deceased was 'A'. However, the court held that injuries found on the person of accused as per medical evidence can be used against him as an incriminating circumstance.

Kate, a resident of Solapur, had gone for a marriage of his friend in Kaudgaon village of Osmanabad district on May 4, 2009. The deceased's family was also from Solapur and had come for the same event. The accused was known for his bad habits and also for drinking. After the dinner, when everybody was busy in marriage preparations, Kate, who was under influence of liquor, took away the girl under pretext of handing her over to her father. After performing the heinous act, he smashed her head by stone.

When the girl could not be traced, her parents lodged a complaint at the nearest police station. The accused was arrested two days later and the session court later awarded him capital punishment after examining witnesses.

Reacting to the judgement, Tejaswini Khade, the president of the Vidarbha Lady Lawyers' Association, said, "Such judgments would act as a deterrent to criminals like Kate. I think law should be stricter to prevent such incidents. In today's scenario, every parent remains concerned about their girls when they are not with them."

Social activist Seema Sakhare felt Kate depicted depravity among humans and "such criminals should be dealt with iron hand". "The court was right in holding that even slight penetration should be accounted as rape. The convict fittingly deserves death for his brutal act," she said.

Mar 25, 2012: 'Divorce epidemic due to sex-starved marriages'

, TNN | Mar 25, 2012, 02.29AM IST
NEW DELHISex-starved marriages leading to divorce are becoming an "epidemic", the Delhi high court has observed, while granting divorce to a husband, maintaining that denial of sex by his wife amounted to mental cruelty.

The man argued that in the five months he and his wife stayed as a couple after marriage, they had sex only 10-15 times. Dismissing the wife's plea against divorce, Justice Kailash Gambhir noted in his order earlier this week: "Although it is difficult to exactly lay down as to how many times any healthy couple should have sexual intercourse in a particular period of time as it is not a mechanical but a mutual act, there cannot be any two ways about the fact that marriage without sex will be an insipid relation."

According to case records, the couple married in February 1991 but the wife left five months later.

The Delhi high court has granted divorce to a husband, maintaining that denial of sex by his wife amounted to mental cruelty.

The court was hearing her appeal against the decision of a lower court to grant divorce to the husband. Denying her husband's charges, she sought the marriage to be restituted.

The man, however, claimed that she had refused to have sex with him on the wedding night and was thereafter unresponsive; she "was like deadwood when he had sexual intercourse with her". Dismissing the wife's plea, Justice Gambhir stressed the importance of a healthy sexual relationship between a normal couple, though there may be exceptions.

"The sanctity of sexual relationship and its role in re-invigorating the bond of marriage is getting diluted and as a consequence more and more couples are seeking divorce due to sexual incompatibility and absence of sexual satisfaction," Gambhir said. "That 'the twain shall become one flesh, so that they are no more twain but one'...(is the) real purpose of marriage ."

The court also took into account the wife's refusal to participate in traditional ceremonies and quarrels with her in-laws. The husband had also accused her of trying to steal jewellery from her mother-in-law. The fact that she slapped a dowry harassment in the Crime Against Women Cell only case to later unconditionally withdraw it, also raised HC's suspicions that her denials were baseless.

While acknowledging that "what happens in the four walls of the matrimonial home and what goes inside the bed room of a couple is either known to them or at the most members of the family", Justice Gambhir found the testimony of the husband more credit worthy because his father seconded it while the wife failed to provide any evidence in her favour.

Mar 24, 2012: Denying sex to spouse on first night ground for marriage annulment: Delhi high court

PTI | Mar 24, 2012, 08.24PM IST
NEW DELHI: Wilful denial of sex, including that on the first night after wedding, by either of the spouse amounts to cruelty and can be a ground for dissolution of the marriage, the Delhi high court has ruled.

Justice Kailash Gambhir gave the verdict, upholding the lower court's decree of divorce to a man having a "sex-starved marriage" as his wife refused to have sexual intercourse with him on the wedding night and making him long for it for the subsequent five months, left her matrimonial home.

"In the present case, the testimony of the husband that the wife was never responsive and was like a dead wood when he had sexual intercourse with her remained unrebutted.

"It is not that the husband had sex with his wife only about 10-15 times from the date of his marriage within a period of five months, but the wife's cruel act of denying sex to the husband especially on the very first night and then not to actively participate in it even for the said limited period for which no contrary suggestion was given by the wife," the court said.

It cited various Supreme Court judgements on the issue and said "it is evident that wilful denial of sexual intercourse without reasonable cause would amount to cruelty."

Referring to the apex court's observation that "sex is the foundation of marriage and marriage without sex is an anathema," Justice Gambhir said, "Marriage without sex will be an insipid relation."
