Oct 30, 2011: 85-yr-old woman gets life for bride burning

PTI | Oct 30, 2011, 10.01AM IST
NEW DELHI: An 85-year-old woman has been sentenced to life imprisonment along with her elder son for burning alive her younger son's wife for failing to fulfil her dowry demands.

Additional Sessions Judge Pawan Kumar Jain held Turkman Gate resident Husan Bano and her son Nasim guilty of harassing her younger son Nasiruddin's wife Gulnaz for dowry and burning her alive on the basis of her dying declaration.

"The dying declaration was made by deceased Gulnaz voluntarily narrating the true facts of incident, which resulted in her death and it was not the result of tutoring as contended by accused persons," said the court.

While relying upon the victim's dying declaration to convict the accused, the court brushed aside the defence counsel contention that her last statement was not supported by even the prosecution witnesses, including her husband, who had turned hostile.

"I hereby sentence both the convicts Husan Bano and Nasim with rigorous imprisonment for life," the judge said, while also imposing a fine of Rs 12,000 on each of them.

As per the prosecution, a day before the incident on October 22, 2008, Husan and Nasim had beaten Gulnaz for failing to bring dowry. The police said the next day when the victim woke up, Husan again picked up a fight with her, while Nasim doused her with kerosene oil and set her ablaze.

Hearing her cries, her husband Nasuriddun and their nephew Shoaib came out and after extinguishing the fire took her to a nearby hospital, where she died two months later.

The victim has been identified as Krishnaa Mahapatra. Officials said the body was trapped between iron rods and the victim must have been pushed off from a height. "We are making inquiries with the site supervisor as well. A case has been registered under Sections 302 and 376 of the IPC," the official said. No arrests have been made yet.

Oct 28, 2011: Delhi remains rape capital

, TNN | Oct 28, 2011, 08.35AM IST
NEW DELHI: Crime in India increased by 4.9% in 2010 with relatively smaller cities like Kochi, Bhopal and Indore reporting higher crime rate - number of crimes per lakh of population - compared to biggies like Delhi, Mumbai and Bangalore.

The capital, however, reported the highest number of 'rape' cases (414) followed by Mumbai (194) among 35 'mega' cities in the country.

These mega cities, having population of over 10 lakh, collectively reported 3,68,883 crimes under the Indian Penal Code in 2010, a rise of 7.3% compared to 3,43,749 crimes in 2009. Although the official crime figures - released by home minister P Chidambaram for the year 2010 on Thursday - showed the usual trends of increase in most crime incidents in India, cases of new age cyber crime jumped substantially by 89.9% last year compared to 2009. Among states, UP accounted for the highest 33.9% of the total crime reported in India last year followed by Andhra Pradesh (13.9%) and TN (11.4%). Overall, the country reported 22,24,831 crimes in 2010 compared to 21,21,345 such incidents in 2009.

Crimes against Schedule Castes (SC), however, declined by 2.6%. Compared to 33,594 cases of crimes against SCs in 2009, 32,712 cases were reported in 2010.

Since crime 'rate' is universally taken as a realistic indicator because it balances the effect of population growth, its increase in cities like Kochi, Bhopal, Indore, Jaipur, Jabalpur , Vijaywada, Patna and Vishakhapatnam will throw a new challenge for the respective state governments. Officials attribute this trend to relatively lesser policing in these cities compared to cities like Delhi, Mumbai, Bangalore, Chennai and Kolkata.

Interestingly, Dhanbad, Chennai, Madurai and Kolkata were the only four mega cities which reported lesser rate of IPC crimes than their domain states - Jharkhand, TN and West Bengal respectively.

The figures, compiled by the home ministry's National Crime Records Bureau (NCRB), are widely referred to by policy makers, police personnel , researchers, NGOs and other stake holders. The Bureau comes out with data on crime in India every year.

"The NCRB has planned to bring out the next edition of these reports (covering the Indian crime scene of the year 2011) in the month of April 2012," a home ministry official said. The bureau hopes that the ongoing 'Crime and Criminal Tracking Network and Systems' (CCTNS) - connecting 15,000 police stations and 6,000 other higher police offices in the country - will be rolled out by March next year, making it possible to compile crime figures on time. The figures show that cases of kidnapping and abduction reported highest increase (13.5%) among all 'violent' crimes in India followed by robbery (4.4%), rape (3.6%) and murder (3%). Report also has separate chapters on policing and police infrastructure.

Oct 26, 2011: Railway engineer gets 10-yr RI for murdering wife

Alok Mishra, TNN | Oct 26, 2011, 07.17AM IST
PATNA: The court of ADJ IX V N Singh on Tuesday awarded 10-year rigorous imprisonment to Rajiv Singh, an engineer with the Indian Railways, for murdering his wife, Rani Archana Singh, for dowry.
Additional Public Prosecutor (APP) Sudhir Kumar Sinha said the court also awarded two-year punishment to Singh for torturing Rani for dowry and two years for concealing evidence. All the punishments would run concurrently, he said.
Sinha had submitted in the court that Rani, daughter of retired ADJ Subhash Chandra Prasad and native of Patna, was married to Rajiv -- a Lalji Tola resident -- in April, 2007. He said soon after the marriage, Rajiv and his family members started torturing her for dowry. "They were demanding Rs 2 lakh from Rani's parents to decorate the newly constructed upper floor of their house," the APP argued.
On August 10, 2007, without any prior programme, Rajiv along with Rani left for Jalpaiguri by Capital Express, added. Four days later while returning to Patna from New Jalpaiguri by the Capital Express, Rajiv claimed that his wife went missing from the train. He lodged a complaint in this regard with the GRP Mokama on August 15, 2007.
The APP contended that during investigation, Mokama GRP found the case to be false and submitted a final report against Rajiv and recommended institution of a separate case against him for lodging a false case.
"In the meantime, Rani's mother Malti Devi filed a complaint petition in the court of the CJM, Patna, alleging murder of her daughter for dowry," the APP said. The court had forwarded Malti Devi's petition to the Gandhi Maidan police station for investigation.
Sinha said an FIR was lodged against Rajiv for harassing his wife and killing her for dowry.
The APP said that six days after Rani went missing from the Capital Express, an unidentified body of a woman was recovered from Katihar section of the railways. The Azamnagar police, who recovered the body, sent it for autopsy, he said and added that the viscera was preserved.
Later the Gandhi Maidan police brought the preserved viscera to Patna and matched it with the blood samples of Rani's parents for DNA test, Sinha said. He said in the DNA test, the viscera matched with the blood samples proving that the unidentified body was that of Rani's.
