NEW DELHI: A woman who conspired with her husband to kill her boss has been awarded life term by Delhi high court. She had allegedly been sexually exploited by him.
HC also convicted the husband, though it acquitted the couple's accomplice, who, according to the prosecution, supplied them with a country-made pistol to kill the man. The court found no evidence linking him to the 2002 murder.
A division bench of Justices B D Ahmed and Manmohan Singh dismissed a joint appeal by oneSapna Talwar and her husband Satyajeet alias Lovely against their conviction and sentencing by the trial court for killing Sapna's employer Vijay Kumar Bajaj in July 2002.
"In view of the testimonies of the witnesses, it is clear that the prosecution has been able to establish on record beyond reasonable doubt that both the accused, Sapna Talwar and Satyajeet, have committed the offences," the bench observed, brushing aside pleas of innocence.
It also convicted the couple on charges of destroying evidence as they had thrown Bajaj into a river in Ghaziabad, but acquitted them of the charge of kidnapping.
Setting aside the conviction and sentence order against co-accused Yunus, the bench said, "We are of clear view that the prosecution has not been able to bring home its case against Yunus as there are many missing links and the chain is far from complete." In Yunus' case the prosecution couldn't complete the chain of circumstances that could prove his involvement.
The prosecution said Bajaj had employed Sapna on Satyajeet's recommendation, but soon began exploiting her. After Sapna confided this to Satyajeet, the duo decided to tie the knot and resolved to kill their boss. On the day of murder, Sapna took Bajaj to a place where Satyajeet joined the duo. The couple persuaded Bajaj to accompany them to Ghaziabad for drinks. Sapna cleverly spiked his alcohol and, along with Satyajeet, threw him into a river in Ghaziabad. They then took flight to Haridwar in Bajaj's vehicle.
They were arrested several days later from Lucknow, where they were trying to hide.
