Though the girl was murdered a month ago, it came to light only on Saturday, a day after the girl's father lodged a complaint that she was missing.
Police said that Uchimahali (18), daughter of Arjunapandian of Kondanagaram near Pettai had eloped with Murugesan (22), son of Vinayagam, residing in the same area. Vinayagam is the elder brother of Arjunapandian. Soon after their families learnt about the affair, they opposed it stating that they were brother and sister. "However, about five months ago, the two eloped. She left along with the two accused in a bus and reached Tirunelveli after dark from where they went in a motorcycle to their native Kondanagaram. However when the motorcycle reached an isolated spot near Kondanagaram, the two strangulated her to death and buried her body in a pit, police said. CHENNAI: K Thilagavathi, a 16-year-old school girl found dead in her house near Gummidipoondi on Wednesday, was killed by her uncle to "protect the honour of the family," police said on Saturday.

K Hari, 37, confessed to having committed the crime and was arrested on Saturday, the police said. They said it was a case of "honour killing" since the girl, a plus-1 student of a government school, had figured in a video clip showing her in physical intimacy with a senior boy of the same school. The girl's father, however, said Hari killed her because of enmity with his family.

Thilagavathi was found hanging on Wednesday and police initially believed it to be a case of suicide. For a couple of days, the video clip showing two girls and five boys in a classroom, has been doing the rounds. The school had expelled Thilagavathy, another girl and five boys on Tuesday.

The girl's father called up the police on Wednesday to say that she was found hanging. After postmortem found that the girl's hyoid bone was fractured, police focused on the murder angle. "We questioned her relatives and Hari confessed to having killed her for bringing bad name to the family," Madharpakkam police inspector K Venugopal told TOI.

Police had earlier arrested three teenage boys and are on the lookout for two other students. Thilagavathi was the first child of M Kumar, an agricultural worker at Sethilpakkam village in Tiruvallur district about 80km from the city.

"We knew there was a video, but there was nothing obscene about it. My daughter was not worried about it. Hari killed her because of previous enmity with us," Kumar said.

Hari has been sent to Puzhal prison. The arrested students were produced before the Juvenile Justice Board and sent to a juvenile home.

She was then dumped in south Delhi after being threatened of dire consequences if she went to police. But the girl did go to the Malviya Nagar police, which has arrested car driver Vasant and mechanic Leelaram Yadav.

A case has been registered under IPC 363 (kidnapping), 366 (kidnapping to compel woman to marriage), 368 (keeping in confinement), 376 (rape) and 506 (criminal intimidation). "They have been sent to judicial custody," said DCP (south) Chhaya Sharma.

The incident comes to light days after a bartender working in Gurgaon was raped by a cab driver on the way back to her house at Masudpur in Vasant Kunj.

According to the FIR, the girl from West Bengal had come to Delhi at the insistence of a cousin who had told her that she could get a job as a sales assistant at a leading cosmetic store. However, she was kept at a businessman's house as a housemaid but was asked to leave it on the night of November 26.

The cops said the girl was spending the night at the Shivalik Road bus stop when, around 2am, accused Vasant approached her and forced her into his car. The girl could not realize where she was being taken. "The accused took her to Ullabas in Gurgaon where he raped her the same night. The girl was then confined in a room while the accused promised to marry her. The girl accepted the offer, hoping she would be released. , TNN | Dec 14, 2011, 01.32AM IST
NEW DELHI: A 19-year-old student from DU has alleged that two cops attempted to molest her inside the Prasad Nagar police station. She claimed they even threatened to make an obscene MMS of her.

The girl said she was picked up for questioning in connection with a kidnapping case in which her cousin is allegedly involved. She further claimed that she was ill-treated as a relative of one of the cops had run away with her cousin.

The girl, a resident of Bapa Nagar, said she was picked up from her uncle's house on Saturday. Although no case has been registered, DCP (central) Vivek Kishore said he has ordered a thorough inquiry. "We are not taking the complaint lightly and a probe has been ordered," he said.

Investigators, however, said there were several inconsistencies in her statement. "She is one of the parties in a habeas corpus petition in the high court which is coming up for hearing later this month. Hence, we do not want to comment on the sensitive issue," said an investigator.

The victim had alleged that she was brought to the police station along with two relatives but was taken to a separate room. According to the complaint, a sub-inspector and a constable came into the room and misbehaved with her. They even took out a phone to film her. But the girl raisedthe alarm and managed to escape.

Sources said the police have decided to probe the incident as they want the investigation into the elopement to be untainted. "We will lodge an FIR if the charges are proved to be true," said an officer. This is not the first time a police officer has been charged with molestation. Last month, a constable was suspended for molesting a 40-year-old woman in a drunken state after he failed to extort money from her husband in east Delhi.

Dec 7, 2011: Tribal woman spends 5 years in jail for rape

, TNN | Dec 7, 2011, 02.46AM IST
AHMEDABAD: A woman cannot be charged with rape under Indian laws. Even the Supreme Court made it clear in its 2009 order in the State of Rajasthan vs Hemraj and Another case that a woman can't be charged under section 376 of the Indian Penal Code (IPC) which refers to rape. And yet a tribal woman from Panchmahal spent the last five years behind bars, after being charged in a rape case.

Jashi Salat, 26, was set free last week, half way through her 10-year jail term, after the Gujarat high court ordered her release. The court found that the minor victim had not been raped and had chosen to leave her home while eloping with a boy.

A trial court in Godhra had punished Jashi with a 10-year jail term along with two other men in 2006 and even booked her under section 376 of IPC. Her appeal came up for hearing before a high court bench of justices D H Waghela and N V Anjaria last week. The bench not only reduced her punishment to ensure her immediate release, it also directed the government's welfare officers to look after her rehabilitation.

Jashi ordeal began when a 14-year old girl from Bhuki village in Panchmahal eloped with Ashok Thakur from Uttar Pradesh. Jashi, a close friend of the girl, and a jeep conductor from a nearby village Pravin Jadav, helped the girl flee.

Thakur, Jadav and Jashi were booked for kidnapping, rape and abetment in 2006 and later convicted by a sessions court. Jashi, a married woman, was pregnant with her third child when she was convicted. The child was born behind bars. Five years in jail had left Jashi disillusioned about slow judicial process and only asked the HC to reduce the jail term during her appeal. Her lawyer also argued that the lower court could not convict a woman of rape.

IPC's definition of rape begins with "A man is said to have committed rape..." Experts say that because of the definition, the law only applies to men.

The HC bench observed that Jashi's friend had not been abducted, as there was no evidence of force or violence. It also considered the three convicts' good behaviour in jail and ordered their release.

"This is a very curious case," said eminent human rights lawyer Girish Patel. "The law states a woman can only abet rape, not commit the act and yet this woman was convicted of rape," he said.
