Aug 31, 2011: Man goes to jail for raping friend's wife

NEW DELHI: A trial court has sentenced a man to seven years rigorous imprisonment for raping his colleague's wife despite the victim's husband, a key prosecution witness, turning hostile during the trial.

Noting that the victim's husband deserted her when she needed him the most , additional sessions judge Rakesh Tewari convicted Chitranjan Kumar and slapped a fine of Rs 5,000 on him.

"During the trial, the victim's husband was won over by some kind of threat or allurement. It is a sorry state of affairs that a husband, who is expected to stand by his wife at such a crisis, deserted her," the judge said.

The prosecution said that the incident occurred in September 2008, when Chitranjan, working in a factory in Bawana in northwest Delhi and living in the same building along with the victim's family on different floors, had raped the woman after finding her alone.

During the trial, Chitranjan contended that he was falsely implicated as he had taken a loan of Rs 10,000 from the victim's husband and was unable to return it. The court, however, rejected his statement saying that a married woman will not choose the stigma of having been raped for the sake of Rs 10,000.
